Welcome to the MyGevity LLC (referred to as “MyGevity”, “We”, or “Us”). MyGevity provides the content and services available on the website located at MyGevityhealth.com, including any subdomains, portals, or mobile applications (collectively, the “Site”) to You, subject to the following terms and conditions (“Terms”) and policies which You may find throughout our Site in connection with functionality, features, or promotions as well as customer service, all of which are deemed a part of and included within these Terms.

These Terms incorporate MyGevity's Privacy Policy (“Privacy Policy”) and Consumer Health Data Privacy Policy (“Health Data Privacy Policy”) by reference in their entirety (collectively, the Privacy Policy and Health Data Privacy Policy are the “Policies”). By accessing and/or using our services, You represent that You fully understand and agree to be legally bound by these Terms and the Policies.

Age Requirements. This Site is not intended for children, and children are not permitted to access this Site. You must be at least 18 years of age to make a purchase on this Site, register on the Site, to provide personal information to Us on this Site, and/or to otherwise use the Site.

IMPORTANT ARBITRATION NOTICE: THESE TERMS CONTAIN AN AGREEMENT TO ARBITRATE IN SECTION 14, WHICH REQUIRES THAT DISPUTES BE RESOLVED BY BINDING ARBITRATION ON AN INDIVIDUAL BASIS. BY AGREEING TO THESE TERMS, YOU WAIVE YOUR RIGHT TO GO TO COURT, HAVE A JURY TRIAL, AND PARTICIPATE IN A CLASS ACTION. PLEASE READ SECTION 14 CAREFULLY.

YOUR AGREEMENT

By accessing or using this Site, You are acknowledging that You have read, understand, and agree, without limitation or qualification, to be bound by these Terms and the Policies. IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS, YOU MAY NOT USE THIS SITE OR SERVICES. Your electronic acceptance of these Terms and access and/or use of this Site has the same legal effect as a handwritten signature.

1. DEFINITIONS

"MyGevity," "We," "Us," "Our," and "Company" refer to MyGevity LLC, a Florida limited liability company.

"You," "Your," and "User" means the individual accessing or using the Site or Services and any entity or organization on behalf of which the individual accessing or using the Site or Services.

"Services" refer to all services provided by MyGevity, including without limitation: (a) facilitating access to Third-Party Provider services(including Quest Diagnostics and True Diagnostics) for sample collection, testing, and other services; (b) providing access to lab results and genetic testing results in a comprehensible format; (c) providing educational information and resources relating to health, wellness, and genetics; (d) selling proprietary supplement formulations; and (e) the Site and related technologies.

"Lab Results" refer to results of laboratory testing obtained through third-party laboratory providers.

"Genetic Data" refers to data derived from genetic testing and related to inherited characteristics.

"Personal Information" has the meaning defined in our Privacy Policy.

"Health Strategists" refers to our staff who provide educational information only and are not licensed medical professionals.

"Third-Party Providers" include laboratories, testing providers, vendors, and service providers not owned or controlled by MyGevity.

2. DISCLAIMERS: MYGEVITY DOES NOT PROVIDE MEDICAL SERVICES

CRITICAL: You must acknowledge and agree to the following to use our Services and to access this Site:

a. MYGEVITY DOES NOT OFFER MEDICAL ADVICE, DIAGNOSIS, TREATMENT, OR ANY FORM OF MEDICAL OPINION. All information provided through our Services is strictly for general educational and informational purposes. MyGevity is not a medical provider. The services offered through this Site and related Services do not constitute medical advice.

b. NOT A SUBSTITUTE FOR QUALIFIED MEDICAL CARE OR ADVICE. The Services are not a substitute for professional medical advice. Always seek the advice of a qualified healthcare provider regarding any medical condition. You agree that You will not delay seeking care or ignore the advice of a qualified medical professional based on information from our Services.

c. OUR HEALTH STRATEGISTS PROVIDE EDUCATIONAL INFORMATION ONLY. Our Health Strategists are not licensed medical professionals and do not diagnose, treat, or prescribe for any medical condition.

d. MEDICAL EMERGENCIES. The use of this Site and the information therein is not meant to be used during emergencies. MyGevity Health Strategists and support staff are not medical providers or emergency services. If You believe You are experiencing a medical emergency, call 9-1-1 immediately and follow the advice of emergency professionals.

e. NO DOCTOR-PATIENT RELATIONSHIP. Your use of our Services or this Site does not establish a doctor-patient relationship between You, MyGevity, or our affiliates.

f. YOU ASSUME ALL RISK. To the fullest extent permitted by law, You assume all risks associated with Your use of the Services and reliance on information provided. MyGevity disclaims all liability arising from any reliance on information provided through our Services.

g. NO WARRANTIES. MyGevity does not warrant the functioning of this Site, that the Services will be uninterrupted, or that the Services and any associated information will meet Your requirements or needs. No oral or written information or advice given by MyGevity or any of its employees, representatives, agents, affiliates, or distributors will create a warranty. The Services are provided “AS IS” and “AS AVAILABLE.” We specifically disclaim all warranties related to the Services and functionality of this Site. Unless otherwise expressly stated herein or if such disclaimers are not available under applicable law, MyGevity and its officers, directors, employees, agents, affiliates, partners, and licensors, disclaim all other warranties, whether express or implied, including without limitation the following warranties: (a) merchantability and fitness for a particular purpose, (b) against infringement of any third party intellectual rights, (c) related to the transmission or delivery of the Services or its content or the uninterrupted availability of the Site, (d) related to the accuracy, reliability, timeliness, correctness, or completeness of the Services, and (e) otherwise relating to the performance of the Services.

h. CHANGES TO TERMS. We reserve the right to change these Terms at any time, in our sole discretion, without further notice, by posting the revised version on this Site. Any changes are effective immediately upon posting to this Site. You may review the current Terms in effect at Terms of Service . Your continued use of the Services or this Site following such updates shall be deemed as an acceptance by You of any changes to these Terms. When We make substantial updates, We may inform You that these Terms have been updated when You log into Your account on this Site.

i. ACCURACY OF SITE AND INFORMATION. We attempt to be as accurate as possible when describing our Services on this Site; however, We do not warrant that the product descriptions, colors, information or other content available on the Site are accurate, complete, reliable, current, or error-free. This Site may contain typographical errors or inaccuracies and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions (including after an order has been submitted) and to change or update information at any time without prior notice. Please note that such errors, inaccuracies or omissions may relate to pricing and availability, and We reserve the right to cancel or refuse to accept any order placed based on incorrect pricing or availability information. However, You will not be responsible for payment for any pricing terms that were not accurate at the time of Your purchase or subscription.

3. PLEASE EXERCISE CAUTION REGARDING LAB RESULTS AND GENETIC DATA

a. Potential for Distressing Information. Your lab results and genetic data may reveal unexpected, sensitive, or distressing information. If You have concerns about pending or received results, or how to interpret them, You should consult a qualified healthcare professional prior to such results to discuss potential risks of testing as well as after receipt of results to discuss accuracy, reliability, as well as potential outcomes or risks of results and treatment, if applicable. Learning about genetic risks or predispositions can be emotionally challenging. If You experience distress or anxiety related to Your results, consider consulting a genetic counselor, psychologist, or other qualified professional for support. Genetic results may also have implications for Your biological relatives. By submitting a sample, You acknowledge and accept that such information may become known to You or others as a result of testing and accept the risks.

b. Irreversibility of Reviewing Results. Once reviewed, lab results and genetic data cannot be “unseen.” Before using our Services, consult a qualified healthcare professional, including a genetic counselor, regarding whether these services are appropriate for Your medical history and circumstances.

c. Risks of Blood Sample Collection. Blood sample collection involves risks, including but not limited to: bruising, hematoma, lightheadedness, dizziness, fainting, infection, and bleeding. You may feel discomfort or anxiety prior to, during, or after the procedure. Consult with laboratory personnel and Your physician or qualified healthcare provider about specific risks.

d. Accuracy and Limitation of Results. While MyGevity strives to facilitate access to accurate and reliable results, You acknowledge that: (i) samples may yield incomplete or inaccurate results; and (ii) MyGevity makes no warranty regarding the accuracy, completeness, or timeliness of any results.

e. Evolving Significance of Genetic Information. Genetic science is a rapidly advancing field. The interpretation of Your results may change as new research emerges. MyGevity is under no obligation to update or reanalyze results based on future discoveries, unless explicitly stated otherwise.

f. Responsible Sharing of Results. Exercise careful discretion in deciding whether and with whom to share Your results. We do not recommend posting Your genetic or lab results on social media or other public platforms.

g. No Substitute for Medical Advice. The Services and any information provided through them, including lab results and genetic interpretations, are for informational and educational purposes only. They are not intended to diagnose, treat, cure, or prevent any disease, or to replace consultation with any qualified healthcare professional. Always seek the advice of Your physician or other qualified healthcare provider with any questions regarding Your health or medical conditions.

h. Data Privacy and Security. MyGevity collects, uses, stores, and discloses personal information, health information, and genetic data in accordance with its Privacy Policy and Health Information Privacy Policy, each of which is incorporated into these Terms by reference. MyGevity maintains administrative, technical, and physical safeguards designed to protect the confidentiality, integrity, and security of such information in compliance with applicable federal and Florida law, including the Florida Information Protection Act (FIPA), the Health Insurance Portability and Accountability Act of 1996 (HIPAA) (to the extent applicable), and other laws governing the protection of health and genetic data. Certain Services require the sharing of information with Third-Party laboratories, vendors, or service providers for purposes such as testing, data processing, hosting, customer support, and regulatory compliance. Such Third-Party Providers are contractually required to maintain confidentiality and implement appropriate security measures consistent with applicable law. While MyGevity employs reasonable safeguards, no method of electronic transmission or storage is completely secure, and MyGevity cannot guarantee absolute security. By using the Services, You acknowledge and accept the inherent risks associated with the electronic transmission and storage of information, and You agree that MyGevity shall not be liable for unauthorized access, disclosure, or loss of data except to the extent required by applicable law.

i. User Responsibility and Informed Consent. By accessing or using the Services, submitting a biological sample, or reviewing any laboratory or genetic results, You affirm that You have read, understand, and voluntarily accept the nature, purpose, risks, limitations, and potential consequences of laboratory and genetic testing, including the possibility of unexpected, inaccurate, incomplete, or emotionally distressing results. You acknowledge that MyGevity does not provide medical advice and that You are solely responsible for consulting with a qualified healthcare professional regarding the interpretation and use of any results or information provided through the Services. You further acknowledge that decisions or actions taken based on the Services, including whether to pursue testing, share results, or act upon information received, are made entirely at Your own discretion and risk. To the fullest extent permitted by law, You assume all responsibility and risk arising from Your use of the Services, and You agree that any dispute or claim relating to informed consent, user responsibility, or reliance on results shall be resolved exclusively in accordance with the dispute resolution and arbitration provisions of these Terms.

j. Third-Party Laboratories and Services. Certain components of the Services, including sample collection, laboratory testing, data analysis, reporting, storage, and related services, are performed by Independent Third-Party Providers that are not owned, operated, or controlled by MyGevity. MyGevity’s role is limited to facilitating access to such Third-Party services and making results available to You in an educational and informational format. MyGevity does not supervise, direct, or control the methods, protocols, personnel, equipment, or operations of any Third-Party Provider, and makes no representations or warranties regarding their services, performance, accuracy, timeliness, or compliance with applicable laws or standards.

To the fullest extent permitted by law, MyGevity disclaims all liability for any acts or omissions of Third-Party Providers, including, without limitation, errors, delays, inaccuracies, contamination, sample handling issues, lost or compromised samples, data breaches, service interruptions, or regulatory noncompliance. You acknowledge and agree that any claims, injuries, losses, or damages arising from or relating to Third-Party Provider activities are the sole responsibility of such Third-Party Providers. Any dispute or claim involving Third-Party laboratories or services, including claims arising from laboratory testing or results, shall be resolved exclusively in accordance with the dispute resolution and arbitration provisions of these Terms, and MyGevity shall not be deemed a party to or guarantor of such third-party services.

k. Limitations of Use. The results provided through the Services are not intended to be used for employment, insurance underwriting, or other non-medical decision-making purposes. Results may not be used for employment, insurance underwriting, or other non-medical decision-making.

l. Re-Testing. MyGevity does not guarantee future re-analysis or reinterpretation of Your genetic data. Any such updates will be offered in accordance with Section 9.

4. ELIGIBILITY

a. By accessing our Services, You represent that You are of sound mind and at least eighteen (18) years of age, are legally capable of entering into a binding contract. You further represent that You have the authority and capacity to: (i) agree to and comply with these Terms; (ii) make purchases and authorize charges; (iii) grant the rights and licenses described in these Terms; (iv) submit personal, health, or genetic information for collection, use, and processing in accordance with our Privacy Policy and Health Information Privacy Policy; and (v) satisfy any payment obligations incurred through Your use of the Services or Site.

b. You may not use our Services if You are:

Currently suspended, restricted, or prohibited from using our Services;
A direct competitor of MyGevity or are accessing the Services on behalf of or for the benefit of a competitor;
Using the Services or Site without proper authorization or in violation of any applicable law or regulation or court order;
Under any legal restriction or court orders that limit Your ability to use the Services; or
Unwilling or unable to agree to these Terms.

c. Residency and Legal Compliance. The Services are intended for use only in jurisdictions where they may lawfully be provided. You are solely responsible for ensuring that Your use of the Services complies with all applicable laws in Your jurisdiction of residence.

d. Account Ownership and Responsibility. Accounts are intended for individual use. You are responsible for all activity occurring under Your account and for maintaining the confidentiality of Your login credentials. You may view and use many features of the Site without registering, including making purchases, but in order to access and use some parts of the Site, You may need to register an account with Us. You are responsible for maintaining the confidentiality of Your account, username and password and for restricting access to Your computer or electronic device. If there has been an unauthorized use of Your password or account, You agree to notify Us immediately. You assume full responsibility for any disclosures of Your private information that occur as a result of password/account sharing, accessing or using the Services in locations that are not private, using unsecure connections, or other practices that jeopardize the privacy of Your information or Account.

You are responsible for providing and maintaining current, complete, accurate and truthful information on Your account. You agree to accept responsibility for all activities that occur under Your account, username and/or password, or because You fail to maintain sufficient security over Your account, username and/or password. You represent that You have the legal authority to agree to these Terms and to accept liability for harm caused by any wrongful use of this Site or Content resulting from access or use under Your account.

You represent and warrant that You own or otherwise control the rights to the information You provided when registering and using Your Account. You agree not to engage in or assist or encourage others to engage in transmitting, uploading, posting, e-mailing, sharing, distributing, reproducing, or otherwise making available any information under or associated with Your Account that (a) is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, pornographic, libelous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable; (b) You do not have a right to make available under any law or under contractual or fiduciary relationships; (c) is known by You to be false, fraudulent, inaccurate or misleading; (d) You were compensated for or granted any consideration by any third party; or (e) infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party.

e. Loss of Eligibility. If at any time You no longer meet the eligibility requirements or become subject to a prohibited condition, You agree to immediately discontinue use of the Services and notify MyGevity at Contact@MyGevityhealth.com. Continued use under such circumstances constitutes a material breach of these Terms.

5. LICENSE TO USE SERVICES

a. Grant of License. By accessing and using our Services, MyGevity grants You a limited, non-exclusive, non-transferable, revocable license to access and use the Services solely for Your personal, non-commercial purposes, conditioned upon Your strict compliance with these Terms.

b. Account Creation and Accuracy. You may create one (1) account for Yourself. You agree to use the Services responsibly, in compliance with all applicable laws, and not to submit false or misleading information, engage in fraud, impersonation, or identity theft, violate intellectual property or privacy rights, or introduce malicious content. You may not create an account on behalf of another person or entity unless You have the legal authority to do so.

c. Account Security and Responsibility. You are solely responsible for maintaining the confidentiality of Your login credentials and for all activities conducted under Your account. You agree to notify MyGevity immediately at contact@MyGevityhealth.com if You suspect any unauthorized access, use, or disclosure of Your account or credentials. MyGevity is not liable for losses arising from unauthorized use of Your account. MyGevity may suspend or terminate Your account immediately for violations of these Terms, unauthorized access, or misuse of third-party services.

d. Deletion of User Content. If You wish to delete certain components of Your public User Content, such as Your ratings and reviews posting(s), on this Site or in connection with our mobile applications, please contact MyGevity by email at Contact@MyGevityhealth.com and include the following information in Your deletion request: first name, last name, user name/screen name (if applicable), email address associated with our website, Your reason for deleting the posting, product associated with deleting request, and date(s) of posting(s) You wish to delete (if You have it). We may not be able to process Your deletion request if You are unable to provide such information to Us. Please allow up to 10 business days to process Your deletion request.

e. Termination of Access. You may terminate Your account at any time by emailing contact@MyGevityhealth.com. MyGevity may suspend or terminate Your account or access to the Services at any time, with or without notice, for conduct that violates these Terms, applicable law, or the integrity or security of the Services.

f. Effect of Termination. Upon termination, Your license to use the Services immediately ceases. Termination does not automatically entitle You to a refund, except as required by law or as expressly stated by MyGevity. All rights not expressly granted remain with MyGevity and its licensors.

6. USER CONDUCT

You agree to use the Services and this Site responsibly and in accordance with these Terms. You represent, warrant, and agree that You will not, directly or indirectly:

a. Violate any local, state, federal, or international law;
b. Submit, upload, or otherwise provide any false, misleading, or inaccurate information, including personal information or sample data;
c. Engage in any form of fraud, misrepresentation, impersonation, or identity theft;
d. Violate, infringe, or misappropriate any intellectual property, privacy, publicity, or other legal rights of MyGevity or Third-Party Providers;
e. Introduce or transmit any malicious code, viruses, spyware, or harmful content or code;
f. Attempt to or actually interfere with, disrupt, damage the operation, integrity, or security our Services, networks, or systems connected to the Services;
g. Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, underlying algorithms, or structure of any portion of the Services or the Site;
h. Use any automated tools, bots, spiders, scrapers, or similar technologies to access, query, or collect information from the Services without prior written consent;

i. Reproduce, distribute, resell, lease, sublicense, or otherwise use the Services or any results for commercial purposes without MyGevity’s prior written authorization;

j. Use any genetic, laboratory, or health information obtained through the Services for discriminatory, exploitative, or unlawful purposes, including decisions related to employment, insurance, or family members;

k. Share, post, or publicly disclose another person’s Personal Information, genetic information, or lab results without their explicit consent; or

l. Attempt to bypass, disable, or otherwise interfere with security-related features or access controls of the Services, or use the Services in a manner that could damage, disable, overburden, or impair MyGevity’s systems or networks.

The products and Services available on the Site, and any samples thereof that may be provided to You through this Site, are for personal and/or professional use only. You may not rent, lease, lend, sell, redistribute or sublicense this Site or the Services.

MyGevity reserves the right to investigate and take appropriate legal or technical action, including suspension or termination of access, if it determines that Your conduct violates these Terms, applicable law, or the security and integrity of the Services. Any disputes related to prohibited conduct shall be resolved under Section 14 arbitration.

7. MYGEVITY'S RIGHTS

a. MyGevity reserves the right, at any time and without notice, to:

Modify, suspend, or discontinue any aspect of our Services;
Update, amend, or discontinue any aspect of the Services;
Refuse, suspend, or terminate Your access to the Services;
Change or discontinue pricing, product offerings, or availability; and
Take any legal, technical, or administrative action necessary to protect the integrity and security of the Services or comply with applicable law.

b. Intellectual Property Rights. All intellectual property rights in the Services, including but not limited to software, designs, trademarks, trade names, logos, graphics, and content, are owned by or licensed to MyGevity. Except as expressly permitted in these Terms, You may not copy, reproduce, modify, distribute, or otherwise use any MyGevity intellectual property, including trademarks, logos, or content, without our prior written consent.

c. User Content and Submissions. To the extent You submit, upload, or transmit any data, feedback, comments, or materials through the Services (“User Content”), You grant MyGevity a non-exclusive, worldwide, royalty-free license to use such User Content for the purpose of providing and improving the Services, consistent with our Privacy Policy. MyGevity reserves the right, but has no obligation, to review, remove, or restrict access to User Content that it determines may violate these Terms or applicable law.

d. Communications. MyGevity may contact You via email, text message, in-app notification, or other reasonable means regarding service-related messages, transaction confirmations, privacy updates, or changes to these Terms. You may opt out of non-essential communications as described in our Privacy Policy.

e. Emails and Texts. Please use caution when e-mailing and texting MyGevity or using other electronic communication tools to communicate with Us. You should consider that all such standard communications tools are not fully secure means of communication. Do not send Us emails, texts, or other electronic communications that include personal or sensitive information. There is some risk that any information contained in standard email, text messages and other electronic communications may be disclosed to, or intercepted, printed, or stored by, unauthorized third parties.

MyGevity cannot ensure the security or confidentiality of messages sent by unsecured email, regular texts, and other non-secure electronic communications. By signing up for the Services and providing Your cell phone number and/or email address, You expressly authorize MyGevity to communicate with You via unsecured text and email communications and accept the privacy risks associated with the same. You further agree to any fees that You incur as a result of the communications (such as from Your telecommunications provider). Unsecured communications related to the Services may consist of reminder emails, application or account updates, and/or other information about the Services. By signing up for these Services, You agree to receive communications in this fashion. You agree to verify the email address and phone number provided to Us and understand that anyone with access to such email or phone number may be able to see the communications We send to You at the email or telephone number You provide to Us.

You will be provided an opportunity to opt out of such communications or may submit Your request directly to Contact@MyGevityHealth.com However, You should note that opting out may impact Your use of the Services.

8. THIRD-PARTY SERVICES AND PRODUCTS

a. MyGevity facilitates access to Third-Party Providers (including Quest Diagnostics, True Diagnostics, and others). MyGevity is not a clinical laboratory and does not perform diagnostic testing itself. Testing is performed by CLIA-certified and/or CAP-accredited laboratories where required by law.

Unless expressly stated otherwise, the Services, reports, and interpretations provided through MyGevity are not cleared or approved by the U.S. Food and Drug Administration (FDA) and are intended solely for informational and educational purposes. You acknowledge that MyGevity is not liable for the collection, processing, analysis, or communication of results by Third-Party Providers, nor for any third-party content, products, services, scheduling, or privacy practices. All disputes arising from third-party services, products, or providers are subject to the binding arbitration provisions in Section 14, and You release MyGevity from any claims related to these Third-Party Providers to the fullest extent permitted by law.

For information about how Your biological sample is collected, stored, or destroyed, please refer to the terms and privacy policy of the laboratory that processes Your sample.

b. IMPORTANT DISCLAIMERS:

MYGEVITY MAKES NO WARRANTY OR REPRESENTATION REGARDING:

The availability, quality, accuracy, or results of any Third-Party Provider services
Any Third-Party Provider's qualifications or credentials
The timing or substance of lab results
Any third-party advice, information, or recommendations

c. MYGEVITY IS NOT LIABLE FOR:

Collection, processing, or analysis of samples by Third-Party Providers
Communication of lab results by Third-Party Providers
Any Third-Party Provider’s content, products, or services
Third-party scheduling, cancellations, or delays
Third-party privacy policies or data practices

d. You agree to release MyGevity from any claims arising from Third-Party Provider services, products, or providers.

e. SUPPLEMENT INFORMATION AND AFFILIATE RELATIONSHIPS

MyGevity provides educational information about supplements through action plans (“Action Plans”) in our portal based on Your genetic and laboratory results.

Supplement information in Your Action Plan is educational and not medical advice
We do not claim that supplements treat, cure, or prevent any disease or medical condition
Our Health Strategists explain supplements that may be relevant to Your genetic variants but do not prescribe or recommend specific medical treatments
Always consult Your healthcare provider before starting any supplement regimen

MyGevity participates in affiliate marketing programs. When You purchase supplements or other products through affiliate links on our website or portal (including, but not limited to, Amazon Associates), MyGevity may earn a commission from the sale. This commission does not increase the price You pay. 9. PAYMENT TERMS

a. You authorize MyGevity to charge Your payment method for all amounts due at the time of purchase, including applicable taxes and fees.

b. You represent that Your payment method will honor charges and You are responsible for any denied payments, chargebacks, or bank fees incurred.

c. All sales are final, and termination does not entitle you to a refund except as expressly in these Terms of Service or otherwise authorized by MyGevity in writing.

d. Refund Policy for DNA Kits and MyGevity Age Tests

The laboratory may not be able to process Your sample, and the laboratory process may result in errors. Refunds are available only in the following circumstances:

Failed Samples

• Initial Failed Sample: If Your initial sample fails processing, We will reprocess the same sample or send a new sample collection kit at no charge.

• Second Failed Sample — Laboratory Error: If both Your initial sample and second sample fail due to laboratory error (where laboratory technicians cannot successfully process an otherwise viable sample), You will be entitled solely and exclusively to a complete refund of the amount paid to MyGevity, less shipping and handling.

• Second Failed Sample — Customer Error: If both samples fail due to customer error, including but not limited to insufficient blood volume, sample contamination during collection, diluted samples, or failure to follow sample collection instructions, no refund will be issued.

No Resubmission After Refund

• If You receive a full refund after two failed processing attempts, You may not resubmit another sample through a future purchase. If You do resubmit through a future purchase and processing is unsuccessful, no refund will be issued.

Uninterpretable Data

Even for processing that meets Our standards, a small fraction of data may be uninterpretable or incorrect. As this possibility is known in advance and is inherent to the testing process, no refunds will be issued for partial data gaps or minor inaccuracies in otherwise successfully processed results. Future re-analysis or reinterpretation of data shall be offered solely at MyGevity’s discretion and may require a separate agreement or fee.

General

• Your blood sample or biological sample, once submitted and analyzed, is processed in an irreversible manner and cannot be returned to You.

• All sales are final once a kit has shipped. No refunds will be issued for dissatisfaction with test results.

• Any refunds issued will be refunded back to Your original payment method and may take up to thirty (30) days to process.

e. Refund Policy for Laboratory Testing Services

Laboratory Testing Cancellation

• Full Refund: If You cancel within forty-eight (48) hours of Your purchase and You have not received lab testing services (e.g., sample collected or results generated), You may receive a full refund.

• No Refund After 48 Hours: After forty-eight (48) hours from Your purchase have passed OR after You receive lab testing services (e.g., sample collected or results generated), whichever comes first, You will no longer be eligible for a refund.

• Any refunds issued will be refunded back to Your original payment method and may take up to thirty (30) days to process.

f. Supplement Sales and Returns

MyGevity sells proprietary supplement formulations developed by MyGevity, and due to health and safety regulations, supplements cannot be returned or refunded once purchased except for damaged and defective supplements.

If You receive a damaged or defective supplement product, contact us within 7 days of delivery at contact@MyGevityhealth.com.
For damaged or defective products: You will be asked to discard the product, and We will send a replacement at no charge. We will cover all shipping costs for replacement products.
No refunds will be issued for supplements except in cases where We are unable to provide a replacement for a damaged or defective product.

g. Subscription Services ("Subscribe & Save")

MyGevity offers subscription services for supplements, DNA kits, laboratory testing, and MyGevity age tests at discounted rates.

Subscription Terms:

Supplements: Available in 30-day, 60-day, or 90-day subscription intervals at 15% off regular pricing.
DNA Kits, Laboratory Testing, and MyGevity Age Tests: Available in 3-month, 6-month, or yearly subscription intervals at 15% off regular pricing.
Subscriptions automatically renew at the end of each subscription period unless cancelled.
You will be charged at the beginning of each subscription period.
Subscription pricing cannot be combined with other discounts or coupon codes.
All subscriptions shall automatically renew without prior notice. You agree to such autorenewal of any subscriptions You have through this Site unless You cancel the subscription before it renews.

Cancellation Policy:

You may cancel Your subscription at any time by following the cancellation link provided in Your subscription confirmation or renewal email, or by contacting us at Contact@MyGevityhealth.com.
You must provide at least 24 hours notice before Your next scheduled billing date to avoid being charged for the next subscription period.
Cancellations received with less than 24 hours notice before billing will take effect for the following billing cycle. You agree to such autorenewal of any subscriptions You have through this Site unless You cancel the subscription before it renews
No Cancellation Fees. There are no cancellation fees.
Subscription Status. Cancelled subscriptions remain active through the end of the current paid period.
No Prorated Refunds. No refunds or prorated refunds will be issued for partial subscription periods after cancellation.

h. Shipping

A shipping fee of $4.99 will be applied to all orders. Orders over $35 qualify for free standard shipping. Shipping fees are calculated at checkout and are in addition to product costs. We are not responsible for delays caused by shipping carriers.

i. Coupon Codes and Discounts

Coupon codes and promotional discounts cannot be combined with subscription discounts or other promotional offers.
Only one discount code may be applied per order.
Discount codes may have expiration dates and specific terms that will be communicated at the time of the offer.

j. Price Correction. MyGevity reserves the right to correct pricing errors and cancel orders related to such errors.

10. YOUR REPRESENTATIONS AND WARRANTIES

You represent and warrant that:

a. You assume all risk and responsibility for determining whether our Services are appropriate, viable, and safe for Your use given Your particular needs and circumstances.

b. You are solely responsible for deciding:

Whether to use any service or product.
Whether and to what extent to seek medical care based on results.
Whether to follow any information or recommendations.

c. You assume all risk for Your acts and omissions in connection with our Services, including any delays in care or failure to seek care and the consequences of such delay or failure to seek care.

d. You will carefully read and follow all instructions from MyGevity and Third-Party Providers.

e. By using the Services, You represent that You are of sound mind, at least eighteen (18) years of age, legally capable of entering a binding contract, and voluntarily consent to these Terms, including the collection, processing, and disclosure of Your personal and health information consistent with MyGevity’ Privacy Policy and Health Information Privacy Policy. You assume all risks associated with the use of the Services, Third-Party Provider results, genetic data, and any recommendations or educational content. You are solely responsible for deciding whether to use any service, follow any recommendation, or seek medical care, and You acknowledge that MyGevity does not provide medical advice or diagnosis.

11. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW:

a. MYGEVITY SHALL NOT BE LIABLE FOR ANY CONSEQUENTIAL, INDIRECT, INCIDENTAL, OR SPECIAL DAMAGES ARISING FROM YOUR USE OF OUR SERVICES OR THE USE OF ANY THIRD-PARTY PROVIDER’S SERVICES OR PRODUCTS.

b. THE MAXIMUM AGGREGATE LIABILITY OF MYGEVITY SHALL BE THE GREATER OF $100 USD OR AMOUNTS YOU PAID FOR THE SERVICES IN QUESTION.

c. This limitation does not apply to matters arising from MyGevity's recklessness or intentional misconduct, or to bodily injury or death directly caused by MyGevity's actions.

12. INDEMNIFICATION

You agree to indemnify, defend, and hold MyGevity harmless from any claims, damages, or losses arising from Your use or misuse of the Services, violation of these Terms, acts or omissions related to Third-Party Provider services, receipt or use of lab results or genetic data, or violation of third-party rights.

13. CHOICE OF LAW AND JURISDICTION

a. These Terms shall be governed by the laws of the State of Florida, without regard to conflict of laws principles.

b. Except as provided in the Arbitration Agreement below, You agree that disputes must be brought in state or federal courts in Pinellas County, Florida.

c. Our Services are intended for use by persons located in the United States. We make no representation that Services are appropriate for use outside the United States.

14. DISPUTE RESOLUTION BY BINDING ARBITRATION

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

a. Agreement to Arbitrate. You and MyGevity agree that any dispute arising from these Terms, the Services, or Third-Party Provider services shall be resolved exclusively through final and binding arbitration under the rules of JAMS, conducted in Pinellas County, Florida, or remotely. This includes disputes regarding data privacy, informed consent, and Third-Party Provider services. Both parties waive the right to a trial by judge or jury, and all claims must be brought individually, not as part of a class or collective action. You may opt out of arbitration within thirty (30) days of acceptance by sending written notice to MyGevity LLC, 7901 4th St N Ste 27675, St. Petersburg, FL 33702.

b. Class Action Waiver. YOU AND MYGEVITY AGREE TO BRING CLAIMS ONLY ON AN INDIVIDUAL BASIS AND NOT ON A CLASS, REPRESENTATIVE, OR COLLECTIVE BASIS. YOU WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION OR CLASS-WIDE ARBITRATION.

c. Jury Trial Waiver. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND MYGEVITY EXPRESSLY, KNOWINGLY, VOLUNTARILY, AND IRREVOCABLY WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY ACTION, CLAIM, COUNTERCLAIM, OR PROCEEDING ARISING OUT OF OR RELATING TO THESE TERMS, THE SERVICES, OR YOUR USE OF THE SERVICES. THIS WAIVER INCLUDES, WITHOUT LIMITATION, CLAIMS ARISING UNDER CONTRACT, TORT, STATUTORY OR COMMON LAW, OR ANY OTHER THEORY. YOU ACKNOWLEDGE THAT THIS WAIVER IS A MATERIAL INDUCEMENT FOR MYGEVITY TO PROVIDE ACCESS TO THE SERVICES, AND THAT YOU WOULD NOT HAVE AGREED TO USE THE SERVICES WITHOUT THIS WAIVER.

YOU UNDERSTAND THAT BY WAIVING YOUR RIGHT TO A JURY TRIAL, ALL DISPUTES WILL BE RESOLVED EXCLUSIVELY THROUGH THE BINDING ARBITRATION PROCEDURES DESCRIBED IN SECTION 14 OF THESE TERMS, EXCEPT AS OTHERWISE PERMITTED BY LAW (INCLUDING SMALL CLAIMS COURT OR EQUITABLE RELIEF FOR INTELLECTUAL PROPERTY INFRINGEMENT). THIS WAIVER APPLIES TO ALL CLAIMS, WHETHER PAST, PRESENT, OR FUTURE, KNOWN OR UNKNOWN, AND COVERS ANY DISPUTE INVOLVING THIRD-PARTY PROVIDERS OR CONTENT. YOU ACKNOWLEDGE THAT YOU HAVE HAD THE OPPORTUNITY TO CONSULT LEGAL COUNSEL BEFORE AGREEING TO THIS WAIVER, AND THAT YOU UNDERSTAND ITS LEGAL CONSEQUENCES.

IF ANY COURT OR ARBITRATOR DETERMINES THAT THIS WAIVER IS UNENFORCEABLE OR INVALID IN WHOLE OR IN PART, SUCH DETERMINATION SHALL NOT AFFECT THE VALIDITY OR ENFORCEABILITY OF THE REMAINDER OF THIS SECTION OR OTHER PROVISIONS OF THESE TERMS. THIS JURY WAIVER IS INTENDED TO COMPLY WITH FLORIDA STATUTES, FEDERAL LAW, AND ANY OTHER APPLICABLE LEGAL REQUIREMENTS GOVERNING CONTRACTUAL WAIVERS OF JURY TRIAL RIGHTS.

d. Arbitration Procedures.

e. 30-Day Opt-Out Period. You may opt out of this arbitration agreement by sending written notice to the address above within 30 days of accepting these Terms. Your notice must include Your name, email, and a statement that You reject the arbitration provision.

15. MISCELLANEOUS

a. You may not assign or transfer these Terms without our written consent. MyGevity may freely assign these Terms.

b. If any provision of these Terms is held to be invalid, illegal, or unenforceable under applicable law, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or, if modification is not possible, such provision shall be deemed severed from these Terms. The remaining provisions shall remain in full force and effect and shall continue to be binding and enforceable. You and MyGevity agree that the intent of these Terms is to preserve all enforceable provisions to the maximum extent permitted by law, and that any severed or modified provision shall not affect the validity, enforceability, or interpretation of the remaining provisions.

c. MyGevity's failure to enforce any provision does not waive our right to enforce it later.

d. These Terms, together with MyGevity’ Privacy Policy and Health Information Privacy Policy, constitute the entire agreement. All notices must be sent to Contact@MyGevityhealth.com or the address above. Sections concerning liability, indemnification, informed consent, third-party disclaimers, and arbitration survive termination. MyGevity may modify these Terms at any time, and continued use constitutes acceptance.
