MYGEVITY LLC TERMS OF SERVICE

Welcome to MyGevity LLC. These Terms of Service (the "Terms") contain essential terms and conditions regarding your use of our services and products. PLEASE REVIEW THESE TERMS VERY CAREFULLY BEFORE USING OUR SERVICES. We encourage you to contact us at info@mygevityhealth.com with any questions or concerns.
These Terms incorporate MyGevity's Privacy Policy and Consumer Health Data Privacy Policy by reference in their entirety. By accessing and/or using our services, you represent that you fully understand and agree to be unconditionally bound by these Terms.
Our services are only available to persons eighteen (18) years of age or older. You must close your browser and may not access or use our services if you are under the age of eighteen (18).
IMPORTANT ARBITRATION NOTICE: THESE TERMS CONTAIN AN AGREEMENT TO ARBITRATE IN SECTION 15, WHICH REQUIRES THAT DISPUTES BE RESOLVED BY BINDING ARBITRATION ON AN INDIVIDUAL BASIS. BY AGREEING TO THESE TERMS, YOU WAIVE YOUR RIGHT TO GO TO COURT, HAVE A JURY TRIAL, AND PARTICIPATE IN A CLASS ACTION. PLEASE READ SECTION 15 CAREFULLY.
1. DEFINITIONS
"MyGevity," "we," "us," "our," and "Company" refer to MyGevity LLC, a Florida limited liability company.
"You," "your," and "User" refer to you as an individual, plus any entity or organization on whose behalf you are acting.
"Services" refer to all services provided by MyGevity, including without limitation: (a) facilitating access to third-party laboratory services (including Quest Diagnostics and True Diagnostics) for sample collection and testing; (b) providing access to lab results and genetic testing results in a comprehensible format; (c) providing educational information and resources relating to health, wellness, and genetics; (d) selling proprietary supplement formulations; and (e) our website at mygevityhealth.com, portal at my.mygevityhealth.com, mobile applications, and related technologies.
"Lab Results" refer to results of laboratory testing obtained through third-party laboratory providers.
"Genetic Data" refers to data relating to inherited characteristics obtained through genetic testing.
"Personal Information" has the meaning defined in our Privacy Policy.
"Health Strategists" refers to our staff who provide educational information only and are not licensed medical professionals.
"Third-Party Providers" include Quest Diagnostics, True Diagnostics, and other laboratory services providers, genetic testing providers, and service providers.
2. MYGEVITY DOES NOT PROVIDE MEDICAL SERVICES
CRITICAL: You must acknowledge and agree to the following to use our Services:
a. MYGEVITY DOES NOT OFFER MEDICAL ADVICE, DIAGNOSIS, TREATMENT, OR ANY FORM OF MEDICAL OPINION. All information provided through our Services is strictly for general educational and informational purposes.
b. OUR SERVICES ARE NOT A SUBSTITUTE FOR QUALIFIED MEDICAL CARE OR ADVICE. MyGevity strongly recommends that you seek the advice of your own qualified healthcare professional to assist you in making decisions regarding any diagnosis, treatment, or care. You covenant that you will not delay seeking care or ignore the advice of a qualified medical professional based on information from our Services.
c. OUR HEALTH STRATEGISTS PROVIDE EDUCATIONAL INFORMATION ONLY. Our health strategists and support staff are not licensed medical professionals. They do not diagnose, treat, or prescribe for any medical condition. They provide educational information only.
d. IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, DIAL 9-1-1 IMMEDIATELY.
e. NO DOCTOR-PATIENT RELATIONSHIP. Your use of our Services does not establish a doctor-patient relationship with MyGevity or our affiliates.
f. YOU ASSUME ALL RISK. To the fullest extent permitted by law, you agree that you use our Services and rely on information received at your own risk. MyGevity disclaims all liability arising from any reliance on information provided through our Services.
3. PLEASE EXERCISE CAUTION REGARDING LAB RESULTS AND GENETIC DATA
a. Your lab results and genetic data may contain unexpected or distressing information. You should consult a qualified healthcare professional if you have concerns about pending results or how to interpret results.
b. Reviewing lab results and genetic data is irreversible. Before using our Services, consult a qualified healthcare professional regarding whether these services are appropriate for your medical history and circumstances.
c. Blood sample collection involves risks including bruising, hematoma, lightheadedness, fainting, infection, and bleeding. You may feel discomfort when blood is drawn. Consult with laboratory personnel and your physician about specific risks.
d. While we strive to facilitate access to accurate results, you acknowledge that: (i) samples may yield incomplete or inaccurate results; and (ii) MyGevity does not warrant the accuracy, completeness, or timeliness of any results.
e. Genetic information may have limited significance currently but may become more meaningful as science evolves.
f. Exercise careful discretion in deciding what aspects of your results to share and with whom. Do not post results on social media.
4. ELIGIBILITY
a. By accessing our Services, you represent that you are of sound mind and at least eighteen (18) years of age, and you have full authority to: (i) consent to these Terms; (ii) pay for purchases; (iii) authorize all rights and licenses granted herein; and (iv) submit Personal Information.
b. You may not use our Services if you are:
- Currently restricted or prohibited from using our Services
- A competitor of MyGevity
- Acting without proper authorization
- Under a legal obligation that restricts your use
- Unwilling to agree to these Terms
c. You agree to immediately cease use and notify us at info@mygevityhealth.com if you become ineligible.
5. LICENSE TO USE SERVICES
a. Subject to your compliance with these Terms, MyGevity grants you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for personal, non-commercial use.
b. You may create one account for yourself. You must provide truthful, accurate, complete, and up-to-date information, including Personal Information. You must update information if it becomes inaccurate.
c. You are solely responsible for maintaining the confidentiality of your account credentials. You are responsible for all activities under your account. Immediately notify us of any unauthorized access.
d. You may terminate your account at any time by emailing info@mygevityhealth.com. Termination does not automatically entitle you to a refund.
6. USER CONDUCT
You represent and warrant that you will not:
a. Violate any local, state, federal, or international law
b. Submit false, misleading, or inaccurate information
c. Engage in fraud, misrepresentation, or identity theft
d. Violate the rights of MyGevity or third parties
e. Introduce malicious code, viruses, or harmful content
f. Attempt to disrupt, damage, or interfere with our Services
g. Reverse engineer, decompile, or otherwise derive our technology
h. Use automated tools (bots, spiders, scrapers) to access our Services
i. Resell or commercially exploit our Services without written consent
7. MYGEVITY'S RIGHTS
a. MyGevity reserves the right to, at any time and without notice:
- Modify, suspend, or discontinue any aspect of our Services
- Update these Terms
- Refuse, suspend, or terminate your access
- Change pricing and availability
b. All intellectual property rights in our Services belong to MyGevity or our licensors. You may not use our trademarks, logos, or content without express written consent.
c. MyGevity may contact you via email, text message, or other reasonable means regarding service messages and updates to these Terms.
8. THIRD-PARTY SERVICES AND PRODUCTS
a. MyGevity facilitates access to third-party laboratory services (Quest Diagnostics, True Diagnostics, and others), genetic testing providers, and other service providers.
b. IMPORTANT DISCLAIMERS:
MYGEVITY MAKES NO WARRANTY OR REPRESENTATION REGARDING:
- The availability, quality, accuracy, or results of any third-party services
- Any third-party provider's qualifications or credentials
- The timing or substance of lab results
- Any third-party advice, information, or recommendations
c. YOU ACKNOWLEDGE THAT YOU HAVE SELECTED EACH LABORATORY AND SERVICE PROVIDER INDEPENDENTLY. No third party, including MyGevity, has referred or recommended providers to you.
d. MYGEVITY IS NOT LIABLE FOR:
- Collection, processing, or analysis of samples by third-party laboratories
- Communication of lab results by third-party providers
- Any third-party content, products, or services
- Third-party scheduling, cancellations, or delays
- Third-party privacy policies or data practices
e. You agree to release MyGevity from any claims arising from third-party services, products, or providers.
f. SUPPLEMENT INFORMATION AND AFFILIATE RELATIONSHIPS
MyGevity provides educational information about supplements through Action Plans in our portal based on your genetic and laboratory results.
- Supplement information in your Action Plan is educational and not medical advice
- We do not claim that supplements treat, cure, or prevent any disease or medical condition
- Our Health Strategists explain supplements that may be relevant to your genetic variants but do not prescribe or recommend specific medical treatments
- Always consult your healthcare provider before starting any supplement regimen
MyGevity participates in affiliate marketing programs. When you purchase supplements through affiliate links provided on our website or portal (including Amazon Associates), we may receive a commission. This commission does not increase the price you pay. Our participation in affiliate programs does not influence the educational information we provide.
9. PAYMENT TERMS
a. You authorize MyGevity to charge your payment method for all amounts at the time of purchase, including taxes and fees.
b. You represent that your payment method will honor charges and you are responsible for any denied payments.
c. All sales are final except as specifically provided in our refund policy below.
d. Refund Policy for Laboratory Testing and Genetic Testing:
DNA Kits and MyGevity Age Tests:
The laboratory may not be able to process your sample, and the laboratory process may result in errors. Refunds are available only in the following circumstances:
- If the initial processing fails due to insufficient DNA volume, insufficient blood quantity, or results not meeting our accuracy standards, we will reprocess the same sample at no charge
- If the second attempt to process the same sample fails, we will send another sample collection kit at no charge for you to collect a second sample
- If the second sample is sent and processing is unsuccessful, you will be entitled solely and exclusively to a complete refund of the amount paid to MyGevity, less shipping and handling, provided you shall not resubmit another sample through a future purchase
- If you resubmit another sample through a future purchase and processing is not successful, no refund will be issued
- Even for processing that meets our high standards, a small fraction of data may be uninterpretable or incorrect. As this possibility is known in advance, no refunds will be issued for these errors
- Your blood sample, once submitted and analyzed, is processed in an irreversible manner and cannot be returned to you
Laboratory Testing Services:
- Full refund available if you cancel within 48 hours of your purchase and you have not received lab testing services
- "Lab testing services received" includes: sample collected or results generated
- After 48 hours from your purchase have passed OR after you receive lab testing services, whichever comes first, you will no longer be eligible for a refund
- Any refunds issued will be refunded back to your payment method and may take up to 30 days to process
Third-Party Provider Denials:
- If a third-party provider denies services you paid for, we will facilitate refund requests with that provider, but refunds are at the provider's discretion
e. Supplement Sales and Returns
MyGevity sells proprietary supplement formulations developed by MyGevity LLC. All supplement sales are final.
- Supplements CANNOT be returned or refunded once purchased, even if unopened or sealed, due to health and safety regulations
- If you receive a damaged or defective supplement product, contact us within 7 days of delivery at info@mygevityhealth.com
- For damaged or defective products: You will be asked to provide proof of damage (such as photos) and to discard the product. We will then send a replacement at no charge and cover all shipping costs for replacement products
- No refunds will be issued for supplements except in cases where we are unable to provide a replacement for a damaged or defective product
f. Subscription Services ("Subscribe & Save")
MyGevity offers subscription services for supplements, DNA kits, laboratory testing, and MyGevity Age tests at discounted rates.
Subscription Terms:
- Supplements: Available in 30-day, 60-day, or 90-day subscription intervals at 15% off regular pricing
- DNA Kits, Laboratory Testing, and MyGevity Age Tests: Available in 3-month, 6-month, or yearly subscription intervals at 15% off regular pricing
- Subscriptions automatically renew at the end of each subscription period unless cancelled
- You will be charged at the beginning of each subscription period
- Subscription pricing cannot be combined with other discounts or coupon codes
Cancellation Policy:
- You may cancel your subscription at any time by emailing info@mygevityhealth.com or through your account portal at my.mygevityhealth.com
- You must provide at least 24 hours notice before your next scheduled billing date to avoid being charged for the next subscription period
- Cancellations received with less than 24 hours notice before billing will take effect for the following billing cycle
- There are no cancellation fees
- Cancelled subscriptions remain active through the end of the current paid period
- No refunds or prorated refunds will be issued for partial subscription periods after cancellation
g. Shipping
A shipping fee of $4.99 will be applied to all orders. Orders over $35 qualify for free standard shipping. Shipping fees are calculated at checkout and are in addition to product costs. We are not responsible for delays caused by shipping carriers.
h. Coupon Codes and Discounts
- Coupon codes and promotional discounts cannot be combined with subscription discounts or other promotional offers
- Only one discount code may be applied per order
- Discount codes may have expiration dates and specific terms that will be communicated at the time of the offer
i. MyGevity reserves the right to correct pricing errors and cancel orders related to such errors.
10. YOUR REPRESENTATIONS AND WARRANTIES
You represent and warrant that:
a. You assume all risk and responsibility for determining whether our Services are appropriate, viable, and safe for your use given your particular needs and circumstances.
b. You are solely responsible for deciding:
- Whether to use any service or product
- Whether and to what extent to seek medical care based on results
- Whether to follow any information or recommendations
c. You assume all risk for your acts and omissions in connection with our Services.
d. You will carefully read and follow all instructions from MyGevity and third-party providers.
e. You are mentally and physically capable of using our Services. If you have any condition that could impact your use, you represent that a licensed medical professional has approved your use.
11. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW:
a. MYGEVITY SHALL NOT BE LIABLE FOR ANY CONSEQUENTIAL, INDIRECT, INCIDENTAL, OR SPECIAL DAMAGES ARISING FROM YOUR USE OF OUR SERVICES.
b. THE MAXIMUM AGGREGATE LIABILITY OF MYGEVITY SHALL BE THE GREATER OF $100 USD OR AMOUNTS YOU PAID FOR THE SERVICES IN QUESTION.
c. This limitation does not apply to matters arising from MyGevity's recklessness or intentional misconduct, or to bodily injury or death directly caused by MyGevity's actions.
12. INDEMNIFICATION
To the fullest extent permitted by law, you agree to indemnify, defend, and hold MyGevity harmless from any third-party claims arising from:
- Your use or misuse of our Services
- Your acts or omissions in connection with our Services
- Your receipt of lab results or genetic data
- Your violation of these Terms
- Your violation of third-party rights
13. DISCLAIMERS AND WAIVERS
TO THE MAXIMUM EXTENT ALLOWED BY LAW:
a. ALL SERVICES ARE PROVIDED "AS IS," "WITH ALL FAULTS," AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.
b. MYGEVITY MAKES NO WARRANTY REGARDING:
- Availability, quality, accuracy, or reliability of Services
- That Services will be error-free or uninterrupted
- The security of your data (though we use reasonable safeguards)
- That results will be complete, accurate, or timely
c. MYGEVITY DOES NOT OFFER MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.
d. Your transmission of data in connection with our Services is at your own risk.
14. CHOICE OF LAW AND JURISDICTION
a. These Terms shall be governed by the laws of the State of Florida, without regard to conflict of laws principles.
b. Except as provided in the Arbitration Agreement below, you agree that disputes must be brought in state or federal courts in Pinellas County, Florida.
c. Our Services are intended for use by persons located in the United States. We make no representation that Services are appropriate for use outside the United States.
15. DISPUTE RESOLUTION BY BINDING ARBITRATION
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
a. Agreement to Arbitrate. You and MyGevity agree that any dispute arising from these Terms or our Services shall be resolved exclusively through final and binding arbitration, except that:
- You or MyGevity may assert claims in small claims court
- Either party may seek equitable relief for intellectual property infringement
b. Waiver of Jury Trial. YOU AND MYGEVITY WAIVE ANY RIGHT TO SUE IN COURT AND HAVE A TRIAL BEFORE A JUDGE OR JURY.
c. Class Action Waiver. YOU AND MYGEVITY AGREE TO BRING CLAIMS ONLY ON AN INDIVIDUAL BASIS AND NOT ON A CLASS, REPRESENTATIVE, OR COLLECTIVE BASIS. YOU WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION OR CLASS-WIDE ARBITRATION.
d. Arbitration Procedures.
- Before filing arbitration, you must send written notice to: MyGevity LLC, 7901 4th St N Ste 27675, St. Petersburg, FL 33702
- The arbitration will be conducted by JAMS under its Consumer Arbitration Rules
- The arbitration will be conducted in Pinellas County, Florida, or remotely
- Each party bears its own attorney's fees unless the arbitrator finds a claim was frivolous
e. 30-Day Opt-Out Period. You may opt out of this arbitration agreement by sending written notice to the address above within 30 days of accepting these Terms. Your notice must include your name, email, and a statement that you reject the arbitration provision.
16. MISCELLANEOUS
a. You may not assign or transfer these Terms without our written consent. MyGevity may freely assign these Terms.
b. If any provision of these Terms is found unenforceable, the remainder shall remain in full effect.
c. MyGevity's failure to enforce any provision does not waive our right to enforce it later.
d. These Terms, together with our Privacy Policy and Consumer Health Data Privacy Policy, constitute the entire agreement between you and MyGevity.
e. We may modify these Terms at any time. Your continued use after modifications constitutes acceptance.
