This Privacy Policy describes how MyGevity LLC ("MyGevity," "we," "us" or "our") processes personal information that we collect through our digital or online properties or services that link to this Privacy Policy, including our website at mygevityhealth.com, our portal at my.mygevityhealth.com, mobile applications, and social media pages, as well as our marketing activities and other activities described in this Privacy Policy (collectively, the "Service").
MyGevity may process personal information that identifies your past, present, or future health or mental health status, or that otherwise constitutes "consumer health data" as defined by applicable U.S. state laws ("Consumer Health Data"). GUIDING PRIVACY PRINCIPLES
Your privacy is one of our top priorities. We empower you to take control of your health, and that includes having control of certain aspects of your personal information. Please read this Privacy Policy in full to understand our personal information practices.
- Your identity is not for sale. In the ordinary course of our daily operations, we do not disclose your personal information to third parties in exchange for money.
- We limit the information we collect and retain. We collect personal information to provide you with our products and services. We retain your personal information for the period of time necessary to fulfill the purposes for which we collected it, including delivering requested products and services and for the period of time required by law.
- We limit how we share your test results with third parties. In order to deliver our products and services to you, it may be necessary for us to provide certain information to our laboratory and provider partners. We limit how such recipients may use your personal information.
PERSONAL INFORMATION WE COLLECT
Information you provide to us or that we generate about you:
- Contact data, such as your first and last name, email address, billing and mailing addresses, and phone number.
- Demographic data, such as your city, state, country of residence, postal code, age, date of birth, and gender.
- Account data, such as username and password, preferences, and any other information you add to your account profile.
- Health-related data, such as mental or physical health history, conditions and diagnoses, treatments, medications, lab samples, lab results, and other physical or mental health information. This may include personal information that you provide directly to us when you complete electronic forms designed for you to self-report your health status or upload medical records.
- Genetic data, certain lab tests available through the Service may produce data that relates to inherited characteristics.
- Transactional data, such as information relating to or needed to complete your orders, including order numbers, transaction history, and purchases of supplements and other products.
- Communications data based on our exchanges with you, including when you contact us through the Service, email, or otherwise.
- Payment data needed to complete transactions, including payment card information or bank account number.
- Marketing data, such as your preferences for receiving our marketing communications and details about your engagement with them.

Third-party sources we obtain personal information from:
- Laboratory and provider partners, including Quest Diagnostics, True Diagnostics, and other third-party healthcare services providers and laboratory services providers.
- Linked third-party devices, such as wearable or Internet of Things devices that you link to your Service account, including historical data related to your use of wearable devices.
- Service providers, third parties that collect or provide personal information in connection with work they do on our behalf.
Automatic data collection:
We, our service providers, and our business partners may automatically log information about you, your computer or mobile device, and your interaction over time with the Service through:
- Cookies, small text files that websites store on user devices.
- Web beacons, also known as pixel tags or clear GIFs, which are used to demonstrate that a webpage or email was accessed.
- Analytics services, such as Google Analytics, to help us understand user activity on the Service.
Consumer Health Data we may create, infer or generate:
We may create aggregated, de-identified, and/or anonymized information from Consumer Health Data by removing certain data components (such as your name, email address, or linkable tracking ID) that makes the data identifiable. Except as required or permitted by applicable law, we will not attempt to re-identify any data that has been aggregated, de-identified, and/or anonymized.
HOW WE USE YOUR PERSONAL INFORMATION
We may use your personal information for the following purposes:
- Service delivery and operations: Providing, operating, and improving the Service; establishing and maintaining your user profile; enabling security features; communicating with you about the Service; providing support and responding to your requests.
- Product fulfillment and customer service: Processing and fulfilling supplement and product orders; managing subscriptions; handling returns and replacements for damaged products; providing customer support.
- Service personalization: Understanding your needs and interests; personalizing your experience with the Service and our communications; remembering your selections and preferences.

HOW WE SHARE YOUR PERSONAL INFORMATION

- Payment processors: Any payment card information you use to make a purchase is collected and processed directly by our payment processors, such as Stripe.
- Third-party fulfillment partners: We share order information with our third-party logistics provider (3PL) to fulfill supplement orders and manage shipping.
- Lab and provider partners: We share your personal information with Quest Diagnostics, True Diagnostics, and other healthcare services providers and laboratory services providers to fulfill testing orders and provide results.
- Research partners: We may share personal information with research partners to conduct research, only with your explicit consent.
- Affiliate marketing partners: As disclosed in our Terms of Service, we participate in affiliate marketing programs including Amazon Associates. When you click affiliate links, those third parties may collect information about your activity in accordance with their own privacy policies.
- Advertising partners: Third-party advertising companies for interest-based advertising purposes. We do not provide health-related information or genetic data to such advertising partners.
- Linked third-party services or devices: If you choose to link a wearable or Internet of Things device to your Service account, we may share your personal information with that third-party service.
- Professional advisors: Lawyers, auditors, bankers, and insurers where necessary in the course of professional services.
- Authorities and others: Law enforcement, government authorities, and private parties as we believe necessary or appropriate for compliance and protection purposes.
- Business transferees: We may disclose personal information in the context of actual or prospective business transactions (e.g., merger, acquisition, sale of assets).
- Third parties designated by you: We may share your personal information with other third parties where you have instructed us or provided your consent to do so.
We do not sell your personal information to third parties for monetary value.
YOUR CHOICES
Access or update your information: If you have registered for an account with us, you may review and update certain account information by logging into the account.
Opt-out of communications: You may opt out of marketing-related emails by following the unsubscribe instructions at the bottom of the email, or by contacting us at privacy@mygevityhealth.com. You may still receive service-related and other non-marketing emails.
If you receive text messages from us, you may opt out by replying STOP to our message.
Cookies: Most browsers let you remove or reject cookies. To do this, follow the instructions in your browser settings. Please note that if you disable cookies, the Service may not work properly.
Advertising choices: You may be able to limit use of your information for interest-based advertising through:

Linked third-party platforms: If you link a wearable or Internet of Things device to your Service account, you may be able to use your settings in your account with that platform to limit the information we receive from it.
SECURITY
We employ technical, organizational, and physical safeguards designed to protect the personal information we collect. However, security risk is inherent in all internet and information technologies, and we cannot guarantee the security of your personal information.
INTERNATIONAL DATA TRANSFER
We are headquartered in the United States and may use service providers that operate in other countries. Your personal information may be transferred to the United States or other locations where privacy laws may not be as protective as those in your state, province, or country.
RETENTION
We generally retain personal information to fulfill the purposes for which we collected it, including for the purposes of satisfying any legal, accounting, or reporting requirements, to establish or defend legal claims, or for fraud prevention purposes. When we no longer require the personal information we have collected about you, we may either delete it, anonymize it, or isolate it from further processing.
CHILDREN
The Service is not intended for use by anyone under 18 years of age. If we learn that we have collected personal information from a child without required parental consent, we will comply with applicable legal requirements to delete the information.

We reserve the right to modify this Privacy Policy at any time. If we make material changes to this Privacy Policy, we will notify you by updating the date of this Privacy Policy and posting it on the Service. Any modifications to this Privacy Policy will be effective upon our posting the modified version. Your use of the Service after the effective date of any modified Privacy Policy indicates your acknowledgment that the modified Privacy Policy applies to your interactions with the Service and our business.
